The canard, I believe, is considered to have flaps because during the flair to landing the elevators will be down. The original vari-eze had no ailerons and therefore weak roll control. The cause is believed to be failure of the elevator linkage to one side of the elevators. The detail was 2 push/pull rods from the stick to the elevator torque tubes. Previously the linkage included differential movement for roll control, but either had been built or converted to no roll control from the elevators. The thinking was as speed increased the wing ailerons were unable to counteract the elevator caused roll. The pilot crashed onto Interstate 480 shoulder during rush hour, missing all vehicles. He had minor injuries, and was released from the hospital within 16 hours.
